Legal & Tax Update in Real Estate

On July 24, the AEB Real Estate Committee held its traditional webinar “Legal & Tax Update in Real Estate”, introducing the audience to the key legislative and tax changes in real estate that have occurred in recent months, as well as to the expected changes. 


The webinar was moderated by Anton Alekseev, Chairman of the Committee. In his opening remarks, Anton noted and briefly commented on some notable innovations in the legal regulation of the industry.

Svetlana Skripnik, Partner, Tax & Legal department, Head of Sector “Real estate, construction, infrastructure” at Kept, presented an overview of the novelties in tax legislation coming into force from 2025. The speaker gave examples from current court practice. She dwelt in detail on cases related to property tax, taxation in cases of lease registration and various financing scenarios. The expert paid special attention to cases of reclassification of an investment transaction into a real estate sale.

Further, Victoria Malashenkova, Senior Lawyer at EPAM Law Offices, spoke about the existing requirements to the quality and safety of real estate objects: mandatory, voluntary and advisory - and highlighted the “problem areas” that had been identified in practice. Based on this, the expert explained the purposes and content of the key changes to the Technical Regulations on the Safety of Buildings and Structures and the system of related regulations that will come into force in September 2024.

Dmitry Bogdanov, Counsel at SEAMLESS Legal, made a presentation on the upcoming changes in shared construction. The relevant draft law was passed by the State Duma on the eve of the webinar and is expected to come into force in September this year. The speaker demonstrated how the new bill will change the approach to regulating the liability of developers and the mechanism for calculating penalties for breach of the deadline for eliminating defects, and also noted the reduction of the warranty period for shared construction projects.
