The AEB Real Estate Committee is pleased to invite you to its open event - Roundtable “Unauthorized Construction: Criteria, Legalization, and Judicial Practice”.
The event will take place on May 14 from 10:00 to 12:00 at the AEB Conference Centre, Moscow Hall, ul. Butyrskiy Val 68/70 bld.1.
According to the RF Civil Code, a person who has carried out an unauthorized construction does not acquire title to it, and the construction itself must be demolished or brought into compliance with the required characteristics. Meanwhile, there are still many unclear aspects related to such real estate status: under what criteria it is determined, what can lead to its attribution, how one can alter it - i.e. how to legalize the construction, as well as many others.
This has accumulated quite a lot of court practice, and the Plenum of the Supreme Court of the Russian Federation has recently issued a separate Resolution (No. 44 of 12.12.2023) "On Some Issues Arising in Judicial Practice in Applying the Norms on Unauthorized Construction", which has significantly changed the approach of the courts to resolving issues of unauthorized construction, making this topic once again one of the most discussed in the industry.
Experts of the Roundtable - specialists of real estate practice in leading law firms - will discuss all the above and other related issues, share their assessment of the current situation and possible risks, and as always, will also provide valuable practical advice and answer questions from the audience.
